What this letter is

The beschikking is the official decision that imposes a traffic fine under the Wahv (the "Mulder" law). It names the offence code (feitcode), the date and place, the vehicle registration, the fine (sanctiebedrag) and € 9 administration costs. The letter goes to the registered keeper of the vehicle on the date of the offence.

Letters sent abroad

EU countries exchange vehicle owner data for traffic offences. The CJIB sends the decision to the keeper's home address in Dutch, often with a short explanation in the language of that country. The same deadlines apply. Unpaid fines of € 70 or more can be collected in the home country. Rental companies receive the fine as keeper, pay it and charge the driver with an administration fee.

Is the letter genuine?

Genuine decisions carry a 16-digit beschikkingsnummer, the CJIB name and address in Leeuwarden and payment instructions that point to cjib.nl or the CJIB bank account. Payment should never go to a private account. The number can be checked on cjib.nl.

Speed measurement

Measured speeds are corrected before the fine is set: 3 km/h below 100 km/h and 3% above. The fine is based on the corrected speed.

Appeal rules

The appeal (beroep) goes to the officier van justitie within 6 weeks after the date on the decision. It must be in Dutch and must state the beschikkingsnummer, the registration, the grounds and the sender's name and address and be signed. No payment is needed to appeal at this stage. A keeper who proves that the vehicle was sold or stolen or rented out before the offence is not liable (Wahv art. 8).

If the letter is ignored

  • After the payment date the fine increases by 50% (first increase).
  • After the second missed deadline a further 100% of the original fine is added.
  • Fines of € 70 or more can be transferred to the authorities of the home country for collection.
  • During a next visit to the Netherlands the police may require payment on the spot.
  • After the appeal date the decision is final.

The options

Pay in full (Betalen)

Appeal to the public prosecutor (Beroep bij de officier van justitie)
The vehicle was sold or stolen or rented out before the offence, the measurement or the vehicle is wrong, or the letter arrived far too late.
